Legal Preparedness as a New Paradigm for Emergency Law in Addressing the COVID-19 Pandemic as a Non-Military Threat in Indonesia

The COVID-19 pandemic exposed limitations in Indonesia’s emergency legal framework in addressing non-military threats while maintaining the rule of law. This study aims to analyze Indonesia’s legal response to the pandemic and to construct legal preparedness as a new paradigm of emergency law. The research employs normative legal research using a qualitative approach through statutory, conceptual, and doctrinal analyses of legislation, legal doctrines, and policy documents. The findings reveal that although Indonesia maintained the rule of law through comprehensive legal instruments, its emergency legal framework remained predominantly reactive due to weaknesses in regulatory readiness, institutional arrangements, coordination mechanisms, and operational preparedness. This study proposes legal preparedness as an integrated framework to strengthen emergency governance, national resilience, and the protection of constitutional rights against future pandemics and other non-military threats.
